As mentioned in our email below, since the CNIPA once judged your trademark can be distinguishable from the cited mark “BLACK BEAR & Device” in another case (appeal in class 35), it’s possible for the CNIPA to judge them as dissimilar in the appeal in class 42 too.Therefore, we don’t strongly suggest appeal against the decision on non-use cancellation, unless the registration of your trademark in class 42 is very important, and you cannot take any risk of refusal.
