Firstly, in our view, it’s unlikely for Shangrao Shi Chu Gao to attack client’s registered trademarks in class 9, as client’s registered trademarks in class 9 are not obstacles to the registration of Shangrao Shi Chu Gao’s application, as client’s trademarks are not registered on the goods in the same classes as those of the designated goods of Shangrao Shi Chu Gao’s application.Secondly, if Shangrao Shi Chu Gao does want to attach client’s registration, even there might be a “non-attack” agreement, it’s still possible for them to attack client’s registration in the name of another company or an individual, and it’s hard for us to find they are related.Based on the above-mentioned, if the registration on the goods in sub-class 0901 is not so important to client, it may not be necessary to negotiate with Shangrao Shi Chu Gao for an agreement and show to the adverse party how much client concerns about possible attack from others to client’s registration. However, if client decides to proceed, kindly let us know. Kindly note we will charge at hourly rate for approaching the adverse party for negotiation and drafting agreement.
