The cited mark was judged as similar to the applied-for mark, as its most distinctive element "TRIBE" is similar to the applied-for mark "TR[1]BE". Even so, in our view, the whole appearance of the cited mark is different from the applied-for mark, and its word element "WATERHUNT" is different from the applied-for mark. We suppose we should have certain space in arguing trademark dissimilarity. Since the judgement on trademark similarity is quite subjective, we are afraid the chance of success may be only 50%.
